In 2023, Liam Morrison, a 12-year-old student at Nichols Middle School in Middleborough, Massachusetts, faced disciplinary action for wearing a T-shirt that stated, “There are only two genders.” His views on gender and sex were deemed “false and harmful.”

Morrison was initially taken out of his first-class after complaints about his shirt. The acting principal insisted he could only come back if he changed attire. Refusing to comply, Morrison was sent home for the day, according to a report by the Boston Herald.

Instead, Liam wore a shirt with the phrase “There are censored genders” written on it. However, fearing detention and suspension, he refrained from wearing either shirt after that.

Morrison’s lawyers, Alliance Defending Freedom (ADF), argued that the school’s actions severely restricted his constitutionally protected expression. After other students complained, Morrison was removed from his first class and instructed to remove the shirt.

His legal representatives drew parallels between Morrison’s shirts and signs displayed in school buildings advocating for the protection of transgender and gender non-conforming students, as well as expressing LGBTQ+ pride.

A judge in Middleboro denied Liam Morrison’s request to wear a “There are only two genders” T-shirt to school under the First Amendment. Despite the ruling, the case isn’t closed. In July, both parties agreed to seek a final judgment, setting the stage for a potential appeal to a higher court.
